Privacy Policy

The short version. We collect what we need to talk with you, plan and shoot your session, deliver your photos and get paid. We do not sell your personal information, we do not share it for advertising, and we do not track you across other websites. You can ask to see, correct or delete your information at any time by emailing info@iconsinmotion.com.

1. Who we are

Icons In Motion Studios Limited Company, doing business as Icons In Motion Studios ("we", "us"), runs iconsinmotion.com and provides photography services from Prosper, Texas and Edison, New Jersey, to clients in Texas, New Jersey and elsewhere in the United States. This policy covers our website, our emails and our photography services. Contact us at info@iconsinmotion.com.

2. Information we collect

  • From you: your name, email, phone, company, preferred date, what you do, your ideas and inspiration links, and how you heard about us; notes from our calls; your storyboard approvals, contract and media release; invoices and payment records; and our messages with you.
  • Photographs: images taken during your session, behind-the-scenes images, and your edited final images.
  • Automatically: when you visit the website, our server records your IP address, browser and device type, the pages requested and the time. We use this to run and secure the site.
  • Sensitive information: a photograph shows a person's appearance, which can reveal things some laws treat as sensitive, such as racial or ethnic origin or a health condition. We use photographs only to deliver your session and for uses you approve in writing. Please do not put health details, government ID numbers or bank or card numbers in the enquiry form.
  • What we do not do: we do not use facial recognition and we do not create face templates or any other biometric identifiers.

3. Why we use it

We use your information to answer your enquiry and book a call; to plan, shoot and deliver your session; to send invoices and keep the financial records the law requires; to show your images in our portfolio or on social media, only with your written permission; to keep the website and our systems secure and to prevent fraud; and to protect our legal rights. We send marketing emails only if you opt in. We limit what we collect to what is reasonably necessary for these purposes.

4. Your photographs

Before we use your images for anything beyond delivering them to you, we ask for your written permission in a media release. You can withdraw that permission for future use. We will then remove the images from our website and social channels within 30 days, though copies already shared or printed cannot be recalled.

5. Who we share it with

We share information only with these kinds of recipients, and only as needed:

  • Service providers that run our systems: Microsoft (email, calendar, booking and document storage), Google Cloud (website hosting), Pixieset (private photo galleries), our bank and Zelle (for payments).
  • Professional advisers, such as our accountant, lawyer or insurer.
  • Authorities, when the law requires it.
  • A buyer or successor, if the business is sold or transferred.

We do not sell personal information. We do not share it for targeted or cross-context behavioral advertising. We have not done either in the past 12 months.

6. Cookies, tracking and Do Not Track

Our website sets only essential cookies that keep it working. We do not use analytics, advertising cookies or tracking pixels, and we do not track you across other websites or over time. Because of that, the site does not change how it behaves when your browser sends a Do Not Track or Global Privacy Control signal. We still treat an opt-out signal as a valid request.

8. Your privacy rights

We give these rights to everyone in the United States, wherever you live. State laws, including those of Texas and New Jersey, set the details.

  • Know whether we process your personal information, and see it.
  • Correct information that is wrong.
  • Delete your information, subject to records we must keep by law.
  • Get a copy in a portable, readily usable format.
  • Opt out of the sale of your information, targeted advertising and profiling. We do none of these, so there is nothing to opt out of.
  • Withdraw consent you have given us.
  • Not be treated unfairly for using any of these rights.

How to ask. Email info@iconsinmotion.com with the subject "Privacy request" and tell us what you want. We may ask for details that match what we hold, such as your email address and session date, to confirm it is you. You may also ask someone to act for you; we will need proof they may. We answer within 45 days. If we need more time we will tell you why and take up to 45 more days. We do not charge for reasonable requests.

If we say no, you can appeal. Reply to our answer with the word "Appeal" within 60 days. We will tell you in writing what we decided within 45 days of receiving your appeal. If you are still not satisfied, you can contact your state's attorney general: in Texas, the Attorney General's Consumer Protection Division; in New Jersey, the Division of Consumer Affairs in the Attorney General's office.

9. Notices for your state

  • Texas: you have the rights listed above under the Texas Data Privacy and Security Act. We do not sell sensitive personal data or biometric data.
  • New Jersey: you have the rights listed above under the New Jersey Data Privacy Act. We do not sell personal data, use it for targeted advertising or use it for profiling that leads to significant decisions about you. We use sensitive information only with your consent.
  • California: in the past 12 months we have collected identifiers and contact details, business information, commercial information (contracts and invoices), photographs, and internet activity data (server logs) as described in section 2. We have not sold or shared personal information, and we do not disclose it to third parties for their own direct marketing.
  • Other states: if your state gives you more rights than listed here, we will honor them. Email us to use them.

10. Children and teens

Our website is not directed to children under 13, and we do not knowingly collect personal information online from them. If we learn we have, we delete it. For anyone under 18, the parent or guardian is our client and signs the contract and media release, and we use the young person's images only as that adult approves in writing. We do not sell or share the information of anyone under 17 for advertising.

11. Security and breaches

We protect your information with encrypted connections, private links for anything shared with you, access limited to the people who need it, and secret keys kept out of our code. No system is completely secure. If a data breach affects you, we will notify you and the authorities as the law requires.

12. Marketing emails

We send marketing only if you opt in. Every marketing email says who we are, includes our postal address and explains how to unsubscribe. We stop sending promptly and always within 10 business days of your request. Emails about your booking, such as confirmations, reminders and invoices, are not marketing and continue while you are a client.

13. Other websites

Our site links to other sites, such as Instagram. Their own privacy policies apply once you leave ours.

14. Changes to this policy

We post any update on this page with a new date at the top. If a change materially affects how we use your information, we will also email clients with an active booking before it takes effect.
